This policy governs the use of the Saints & Stars website (the "Website”) and the Saints & Stars application (the "Application"). The Website is designed to allow users to make class/series purchases, register for classes, book spots, buy merchandise, and communicate with Saints & Stars B.V. ("Saints & Stars"). The App is designed to allow users to make class/series purchases, register for classes and book spots.
1. General Statement on Privacy, Personal Data and Communication
1.1 If a person uses the Website and/or Application, they are responsible for maintaining the confidentiality of their account, password, and for restricting access to their computer or device. The user agrees to accept responsibility for all activities that occur under their account and/or password.
When the Website is visited, or Saints & Stars is communicated with via email, the user communicates electronically. The user consents to receive communication from Saints & Stars electronically. Saints & Stars will communicate by email, telephone number as provided on the member’s account, or by posting notifications on the Website. The member understands and agrees that all agreements, notices, disclosures, and other communications that Saints & Stars provides electronically, satisfy the legal requirement that such communications be in writing.
2. Provided User Information
2.1 Saints & Stars does not collect any personal information about individuals -- such as names, postal codes, home addresses, and email addresses -- except when such information is knowingly provided to Saints & Stars. Personal information might be obtained from online transactions such as class/series purchases, retail purchases, and/or class registrations. Additionally, personal information may be transmitted as part of a form submission or in connection with other activities or services made available on the Website. Any personal identification information retrieved by Saints & Stars must be voluntarily submitted by the user.
2.2 Saints & Stars may use information provided to contact a member with important information, required notices, and marketing promotions.
3. Security Statement
3.1 Saints & Stars makes every effort to ensure that all transactions occurring on the Website and the Application are secure. All credit card numbers and transactions are encrypted using 128-bit Secure Socket Layer (SSL) encryption. Saints & Stars is concerned about safeguarding confidentiality of members and visitors. Saints & Stars provides physical, electronic, and procedural safeguards to protect information processed and maintained. For example, Saints & Stars limits access to such information to authorized employees and contractors who need to know that information in order to operate, develop or improve the Website and Application.
4. How Information is Used
4.1 The following are examples of how Saints & Stars might use personal information collected through the Website:
- If a member purchases Saints & Stars class credits, signs up for a Saints & Stars class, or purchases Saints & Stars retail items, the required personal information (similar to that provided during a telephone or mail order purchase) will be used to complete the order.
- If a member indicates that they are interested in receiving Saints & Stars related news and information, they may receive emails to the email address provided as part of the registration process.
- For the non-personally identifiable information collected throughout the Website and Application: aggregate data could be analyzed to describe the collective characteristics and behaviors of online visitors, and subsequently be used to further optimize the effectiveness of the Website, Application and the overall Saints & Stars experience.
4.2 Members can help Saints & Stars maintain the accuracy of personal information by updating their account. Please update this information when changes occur in home address, phone number, or email address. Saints & Stars will never share telephone numbers, email addresses, or any personal data with third parties.
4.3 Saints & Stars reserves the right to refuse service, terminate accounts, remove or edit content, and cancel orders, at its sole discretion.
5. Privacy of Minors
5.1 If a member is under 18, they may register and use the Website and Application only with the involvement of a parent or guardian. Saints & Stars does not accept online registration of minors; members below the age of 16 should not attempt to register on the Website.
5.2 A parent or guardian must sign a waiver on behalf of a minor before the minor shall be permitted to participate in a class. A minor must be at least 15 years of age to participate in a class.
5.3 If Saints & Stars discovers that personal information has been submitted by a minor without a signed participant/registration waiver, Saints & Stars reserves the right to delete such information and terminate access to its facilities. Saints & Stars does not seek or share personal information from minors throughout the Website and/or Application.
6. Reservations / Charges
6.1 In order to make a reservation, a member must first own a single class, multiple classes, or a membership. To buy a class, multiple classes or a membership online, a member can either sign up on this Website and Application by using personal email and creating a password, or, if already registered, log in to buy classes or memberships and make reservation(s).
6.2 Classes/credits have an expiration date stated on the pricing page on the Website and Application, and future prices are subject to change.
6.3 Saints & Stars accepts MasterCard, Visa, American Express and Maestro.
6.4 A member’s credit/debit card will be charged for the order when the reservation is submitted. Saints & Stars will not process reservation charges that use an incorrect, expired, or over-the-limit credit card. Saints & Stars makes the best effort to contact the member if this occurs. If a member fails to pay fees or charges due, services or privileges may be suspended and/or terminated. The member shall be liable for any external fees, including attorney fees and collection costs that Saints & Stars may incur in its efforts to collect any unpaid balances.
6.5 In addition to classes and series of classes, Saints & Stars may be offering gift certificates. Saints & Stars’ gift certificates are called "gift cards". Gift cards never expire and the person receiving them can use his or her gift card(s) to buy classes. Once a class is purchased using a gift card, it will expire, just like any other class bought.
6.6 The expiration date of classes/credits is stated on the pricing page of the Website and Application and is subject to change at any point in time.
6.7 Gift cards and classes are not the same thing. Unlike gift cards or gift certificates, classes are for regular group-fitness workouts only. When a class is purchased, the member is entitled to use that class to book a spot in a particular Saints & Stars studio at a particular time only. A member shall not redeem a class for cash, and a class cannot be transferred to another person, unless a written permission is given by Saints & Stars.
6.8 Classes do expire. Expiration dates are posted on the description of the class or series of classes on the Website and Application. Future class prices are subject to change, however, Saints & Stars will honor a member’s class or series of classes until the expiration date, regardless of whether there is a price increase in the interim.
6.9 A member’s credit/debit card will be charged for the order when classes are purchased, not when classes are booked.
6.10 All introductory offers, promotions and discount codes are for one-time use only per individual, unless explicitly indicated to the contrary.
6.11 Saints & Stars reserves the right to charge full price in the event of an introductory offer, promotion or discount code on a duplicate basis to purchase a class or series. Should Saints & Stars charge a member full price, the member’s rights to then cancel such class or series and/or to receive a refund shall continue to apply in accordance with our standard cancellation and refund terms. Saints & Stars reserves the right in its discretion to immediately cancel all accounts linked to the member in such circumstance.
6.12 All introductory offers, promotions, discounted credits or memberships have an indication of their validity stated on the pricing page on the Website and Application, which may differ from standard class or membership expiry. It is a member’s individual responsibility to be aware of any changes in price or expiration of classes/credits after the introductory offers, promotions, discounted credits or memberships end.
6.13 Special discount codes communicated on social media by our partners (or influencers) are valid for 3 months.
7. Required Equipment
7.1 Member safety and physical well-being is of primary importance to Saints & Stars. In order to participate in a boxing class, it is mandatory for all participants to use gloves and/or wraps. Saints & Stars reserves the right to refuse entry into the class if a member chooses not to wear such equipment. The member will not be refunded for the class in such circumstance.
8. Right to Cancel
8.1 A member may cancel their purchase of unused classes and memberships at any time before midnight of the fourteenth business day after the date of the purchase, excluding Sundays and holidays. To cancel, a member has to mail, e-mail or deliver a signed and dated notice which states that the member is cancelling the purchase. Such note shall be sent to info@saints-stars.com or Saints & Stars B.V. Escapade 1, 1183 NM Amstelveen with a title ‘Attention: Refunds’.
8.2 Saints & Stars will refund the purchase price of unused classes within 10 (ten) working days after receiving the notice of cancellation.
9. Additional Rights to Cancel
9.1 A member, or an official representative may also cancel the purchase of a class or classes for any of the reasons listed in the article 9.2. To do so, a written notice, either via e-mail or registered mail has to be sent to info@saints-stars.com or Saints & Stars B.V. Escapade 1, 1183 NM Amstelveen with a title ‘Attention: Refunds’.
9.2 A member may cancel classes, a membership or Personal Training contract in any of the following circumstances:
- If a member becomes disabled and, as a result, cannot physically participate in classes purchased, and such condition is verified by a certified medical practitioner. Saints & Stars will then refund the purchase price of the unused class or classes.
- If a member dies, Saints & Stars will refund a representative the purchase price of the unused class or classes.
- If a member moves their residence more than 50 kilometers from a Saints & Stars location. Saints & Stars will then refund the purchase price of the unused class or classes. Depending upon the residence of the member, they may be charged a cancellation fee. All such refunds are subject to an official proof of change of mailing address.
- If Saints & Stars stops offering classes, a member may cancel their purchase and receive refund.
9.3 In addition to member rights of cancellation and refund, if a member wishes to simply cancel a spot reserved in a class, they may do so up until 8 hours before the start of the applicable class, and in such case the member’s unused class will be returned to the member’s account to be used at a future date.
9.4 A member can cancel a reserved spot in the following ways:
- Log into the personal account and, next to the class wishing to be cancelled, press "cancel"
- The 8-hour cancellation rule applies in instances provided in this article
9.5 For clients running late: there will be no entry into the studio after the class has started
9.6 For clients leaving early: If a member is planning on leaving early, Saints & Stars kindly requests that the member informs the instructor ahead of time
9.7 For clients coming to Saints & Stars for the first time: for safety reasons, an introduction to the class is mandatory and is given 5 minutes prior to the class. First Timers must be present at the club no less than 10 minutes before the beginning of the class. Failing to join the introduction will result in no entry to the class
9.7 When you sign up for a waitlist, a credit will be taken from your account. As soon as a spot opens up, you will be automatically booked for the workout (up to 8 hours prior to the class). During the last 8 hour to the class, you will be notified via email about the possibility to book a class. Standard cancellation policies also apply. If you didn't succeed to get a spot your credit will be returned within 24 hours.
9.8 For clients on the waiting list: 8 (eight) hour prior to class, clients on the waiting list will be notified via email about the possibility to book a class due to other member cancellations. If a member receives such notification, they are responsible for making the reservation. Standard cancellation policies also apply
10. Retail Returns
10.1 Unwashed, unworn, and labelled items can be returned within 30 days of purchase for a refund, or Saints & Stars class credit only.
10.2 Receipt or proof of purchase must accompany the return in order to process the refund. All sale items and all accessories, including, but not limited to, gloves, wraps, and water bottles, are final sale unless stated otherwise.
11. Personal Training
11.1 Personal Training sessions are only refundable if cancelled by calling the applicable studio no later than 12 (twelve) hours before the start of the session.
12. Private Events
12.1 Event fees are due and payable at the time of booking and are non-refundable.
12.2 All attendees must agree to these Terms and Conditions prior to attending the event.
12.3 Any third-party vendor that Saints & Stars may permit clients to bring into a Saints & Stars facility as part of a private event must include Saints & Stars as an additional insurance to such party’s general liability as a condition to the grant of such permission.
13. Waiver and Release
13. 1 By signing up for and/or attending classes, events, activities, and other programs and using the premises, facilities and equipment (individually and/or collectively, the "Classes and Facilities") of Saints & Stars and its subsidiaries, the client hereby acknowledges, on behalf of themselves, their heirs, personal representatives and/or assigns, that there are certain inherent risks and dangers in boxing, HIIT workouts and exercise equipment in association with the Classes and Facilities. The member acknowledges that some of these risks cannot be eliminated regardless of the care taken to avoid injuries. The member also acknowledges that the specific risks vary from one activity to another, but range from (1) minor injuries such as scratches, bruises, and sprains; (2) major injuries such as eye injury or loss of sight, joint or back injuries, heart attacks, and concussions; and (3) catastrophic injuries including paralysis and death.
13.2 At all times, the member shall comply with all stated and customary terms, posted safety signs, rules, and verbal instructions given by staff of Saints & Stars.
13.3 If in the subjective opinion of the Saints & Stars staff, the member would be at physical risk participating in Saints & Stars’ Classes, the member understands and agrees that they may be denied access to the Classes and Facilities until delivering Saints & Stars an opinion letter from a certified medical practitioner, at the sole cost and expense of the member, specifically addressing Saints & Stars’ concerns and stating that Saints & Stars’ concerns are unfounded.
13.4 In consideration of being allowed to participate in and access the Classes and Facilities, the member hereby (1) agrees to assume full responsibility for any and all injuries or damage which are sustained or aggravated by the member in relation to the Classes and Facilities, (2) release, indemnify, and hold harmless Saints & Stars, its direct and indirect parent, subsidiary affiliate entities, and each of their respective officers, directors, members, employees, representatives and agents, and each of their respective successors and assigns and all others, from any and all responsibility, claims, actions, suits, procedures, costs, expenses, damages, and liabilities to the fullest extent allowed by law arising out of or in any way related to participation in the Classes or use of the Facilities, and (3) represent that the member (a) have no medical or physical condition that would prevent them from properly using any of Saints & Stars’ Classes and Facilities, (b) do not have a physical or mental condition that would put the member in any physical or medical danger, and (c) have not been instructed by a physician to not participate in physical exercise. The member acknowledges that by having chronic disabilities or conditions, they are at risk by using Saints & Stars’ Classes and Facilities, and should not be participating in any Classes.
14. Valuables and Personal Property
14. 1 Clients acknowledge that they have been urged to avoid bringing valuables into and unto the Facilities and that Saints & Stars shall not be liable for the loss of, theft of, or damage to personal property, including items left in lockers, bathrooms, studios, or anywhere else in the Facilities. Clients acknowledge that no portion of any fees paid by them is in consideration for the safeguarding of valuables.
15. Etiquette
15.1 Saints & Stars reserves the right to deny access to any person Saints & Stars deems to be acting in an inappropriate or unsafe manner.
15.2 Members cannot bring their children to the clubs and leave them unattended. Pets are not allowed in our clubs.
15.3 In the lounge it is mandatory to wear clothing.
16. Intellectual Property Rights
16.1 The trademarks and trade dress of Saints & Stars are proprietary to Saints & Stars and may not be used for any reasons other than as expressly permitted by these terms.
16.2 All Website and Application content, design, text, graphics, and interfaces; the collection, selection, and arrangement thereof; and all software are property of, or duly licensed to, Saints & Stars. Users have the right to view, electronically copy, and print in hard copy portions of the Website for the sole purpose of making class reservations, purchases, or other personal use.
16.3 Any other use of materials on the Website and Application, including modification, distribution, or reproduction for purposes other than those noted on article 16.2, without a prior written permission of Saints & Stars, is strictly prohibited.
16.4 Users acknowledge that Saints & Stars and/or third-party content providers remain the owners of all Website and Application materials, and that users do not acquire any of those ownership rights by downloading, copying, or using any such material in accordance with these Terms and Conditions.
16.5 Saints & Stars may discontinue or remove the Website and/or Application, or any portion thereof, or discontinue user right to use the Website and or Application, or any portion thereof, at any time.
16.6 As between the member and Saints & Stars, the member owns all content submitted to Saints & Stars. The member grants Saints & Stars and its affiliates a worldwide, perpetual, irrevocable, non-exclusive, sub-licensable (through multiple tiers) royalty-free license and right to use, copy, transmit, distribute, publicly perform and display (through all media now known or hereafter created), and make derivative works from member content (including, without limitation, member name and likeness, photographs and testimonials) for any purpose whatsoever commercial or otherwise without compensation. In addition, the member waives any so-called "moral rights" in their content. The member further grants all users of Saints & Stars’ services permission to view the content for personal, non-commercial purposes.
16.7 In participating in Saints & Stars’ classes, the member may be photographed, videoed or otherwise recorded by Saints & Stars or third parties authorized by Saints & Stars in its or such third parties producing of content which, among other things Saints & Stars or such third parties may use to advertise, report upon, market and/or promote Saints & Stars and its services. The member hereby consents to such usage of imagery for all and any such purpose by Saints & Stars and such third parties and hereby agrees that Saints & Stars and such third parties without any payment to the member shall in all cases be the sole owner of all intellectual and other proprietary rights therein without any restriction whatsoever.
17. Not Authorized to Perform Data Mining
17.1 A user is not authorized, without prior written permission of Saints & Stars, to use any computer code, data mining software, "robot," "bot," "spider," "scraper" or other automatic device, program, algorithm or methodology having similar processes or functionality, or any manual process, to monitor or copy any of the web pages, data or content found on this Website or accessed through this Website or Application.
17.2 A user may not engage in mass downloading of files from this Website; use the computer processing power of this Website for purposes other than those permitted above; flood this site with electronic traffic designed to slow or stop its operation; or establish links to or from other websites to this Website.
18. Not Authorized to Use this Website for Commercial Purposes
18.1 Users are not authorized to sell, reproduce, distribute, modify, display, publicly perform, report or otherwise prepare derivative or second-hand works based on any of Saints & Stars’ material in any way for any public or commercial purpose. Thus, users are not authorized to (i) resell or make commercial use of this site or its contents; (ii) collect or use any product listings, descriptions, photographs or prices displayed on this Website in connection with the sale or resale of any Saints & Stars products or for other commercial purposes; or (iii) create, reproduce and/or distribute any materials derived from the content provided on this Website.
18.2 Saints & Stars’ material may not be displayed or communicated on any other website and/or app, in a networked computer environment or other digital support for any purpose whatsoever. In the event of breach of any of these Terms, the permission to use Saints & Stars’ material will automatically terminate and any copies made of Saints & Stars’ material must be immediately destroyed.
18.3 Any unauthorized use of Saints & Stars’ material may violate national criminal laws, infringe copyright laws, trademark laws, the laws of privacy or publicity, and communication regulations and statutes.
19. Warranty disclaimer and limitation of liability
19.1 In no event will Saints & Stars be liable for any direct, indirect, special, or other consequential damages resulting from visitor or member use of the Website and Application, or on any other linked/third-party website, including without limitation, any lost profits, business interruption, loss of programs, or other data on user information handling systems or otherwise, including any claims waived by the visitor or member previously in this agreement even if Saints & Stars expressly advised of the possibility of such damage.
19.2 All information is provided by Saints & Stars on an "as is" basis only. Saints & Stars provides no representations and warranties, express or implied, including the implied warranties of fitness for a particular purpose, merchantability, and non-infringement.
20. Choice of Law
20.1 The Website and Application, and visitor/member use hereof, is governed by the laws of the Netherlands. Any claim arising out of the use of this Website and Application must be brought in Amsterdam.
21. Policy Changes
21.1 Occasional changes may be made to this document as new services and content are added to the Website and Application to reflect changes in Saints & Stars’ policies. The Terms and Conditions may be revised at any time by updating this posting. By using the Website and Application, the user agrees to be bound by any such revisions. Users of the Website and/or Application are encouraged to check this document periodically to stay informed of current privacy guidelines.
22. Acceptance of Terms
22.1 By using the website and/or Application, setting up an account and buying products and/or services on the Saints & Stars website and/or Application, the user signifies the acceptance of the Terms and Conditions. If the user does not agree to the provisions, they should refrain from using the Website, the Application and services of Saints & Stars. User continued use of the Website and/or Application following the posting of changes to these terms will indicate the acceptance of those changes.
1. General information
1.1. As soon as a member creates an account on the Saints & Stars Application or an official website of Saints & Stars, namely www.saints-stars.com, signs up for a membership (hereinafter referred to as the ‘’Gold Flex’’, ‘’Gold 1 year’’ or “Personal Training”), via either this Website, Application or at any Saints & Stars location, they will automatically accept these Terms and Conditions and become a member (hereinafter: the “Member”) of Saints & Stars. (hereinafter: “Saints & Stars”).
2. Terms and Conditions
2.1. These Terms and Conditions apply to all services provided by Saints & Stars and, as such, govern the legal relationship between Saints & Stars and the Member.
2.2. Saints & Stars is authorized to amend the Terms and Conditions governing the membership and services at any point in time.
2.3. Saints & Stars is authorized to increase their prices at any time with a maximum of 9% per year.
3. Memberships
3.1. The Member is aware they are entering into the membership for the agreed term as stated on the website and the Application, which begins on the date of the purchase of the first 4 (four) weeks of the membership.
3.2. Saints & Stars offers 2 (two) types of Unlimited Gold memberships, namely Gold Flex, amounting to 159 (one hundred and fifty-nine) euros per 4 (four) weeks, and Gold 1 Year, amounting to 129 (one hundred and twenty-nine) euros per 4 (four) weeks.
3.3. The prices stated in Article 3.2 of these Terms and Conditions are inclusive of VAT. Saints & Stars is authorized at any time to adjust its rates in the event of any changes to the amount of the VAT.
3.4. The minimum commitment period for Gold Flex is 4 (four) weeks of active membership
3.5. The minimum commitment period for Gold 1 year is 52 (fifty- two) weeks of active membership
3.6. Both memberships give The Member unlimited workouts every 4 (four) weeks.
3.7. Both Gold Flex and Gold 1- Year memberships will be extended automatically after their initial commitment periods. After this initial period a 4- week cancellation policy applies, requested by The Member in writing.
3.8. Both Gold Flex and Gold 1-year memberships offer 1 (one) complimentary PT session within the entire duration of the membership.
3.9. Complimentary PT sessions have to be arranged within 60 days from the moment a Member obtains either Gold Flex or Gold 1-year membership
3.10. Gold Membership PT session(s) cannot be redeemed with class credits, nor are they cumulative with any unused, previous or other complimentary PT sessions offered as part of various Saints & Stars promotions.
3.11. The Member is obligated to cover any outstanding payments before the termination date. Not complying with this regulation will result in 2 (two) official warnings sent to the Member in writing, followed by engaging in the services of an external collection agency in order to obtain any outstanding payments. Saints & Stars is authorized to decline access to its facilities and/or suspend the membership for the Member not complying with this regulation until all outstanding payments are covered.
3.12. The membership is strictly personal and can only be transferred with the permission of Saints & Stars. Such request has to be done in writing by the Member holding the membership to the official email address of Saints & Stars: info@saints-stars.com.
3.13. Saints & Stars reserves the right to request Members for identification at any point while on the premises.
3.14. During the opening hours of a Saints & Stars location, the Member is entitled to use the facilities of Saints & Stars anywhere within its operation.
4. Membership fees
4.1. The membership fee must be paid by the Member using Stripe Direct Debit or, alternatively, by card at the reception of Saints & Stars or via a pay-link issued to the Member’s email address, for the entire 4-week term of the membership in advance, on a 4-weekly basis, or, if required, for the initial term of the contract (or an extension thereof).
4.2. Saints & Stars reserves the right to collect overdue payments through Stripe Direct Debit.
4.3. If a Stripe Direct Debit is rejected, Saints & Stars will send an automatic reminder in writing to the Member requesting to cover the outstanding payment. Should the payment remain incomplete, 2 (two) official warnings will be issued in writing to The Member, followed by opening a case within an external collection agency to obtain the outstanding payment.
4.4. If Saints & Stars is compelled to engage the services of a collection agency in order to collect payment from the Member, the latter will also be required to pay administrative charges and any extrajudicial collection costs in the amount in accordance with the scale of collection costs. The Member will not be authorized to use the services and facilities provided by Saints & Stars until such time as their overdue debt has been settled in accordance with the arrangements made with the collection agency.
4.5. Saints & Stars occasionally offers discounts on regular membership fees during special promotions that are indicated on this Website and Application. These discount types are always applicable to the first 4 (four) weeks of the membership only, unless specified otherwise on the actual promotion. Discounts can never be granted retroactively, and a discounted Gold Flex membership has a minimum 4 (four)-week commitment period including the first discounted 4 (four) weeks before it can be terminated under articles 6.1 and 6.2 of these Additional Terms and Conditions
4.6. Saints & Stars imposes a no-show fee of 15 (fifteen) euros should the Member book a class and/or a complimentary PT session and not be present without cancelling it. Saints & Stars imposes a late-cancel fee of 7,50 (seven fifty) euros should the Member cancel the class less than 8 (eight) hours prior. Saints & Stars will initially issue a warning email, which will be followed by a Stripe Direct Debit from the Member’s bank account. If the Member fails to complete the payment in timely manner, provisions in Article 4.2 of these Terms and Conditions will apply.
4.7. Members may inform Saints & Stars in writing to the official Saints & Stars informational email address (info@saints-stars.com) about an emergency resulting in not being able to attend the class within the 8-hour cancellation window and thus requesting to waive the no-show fee. Saints & Stars possesses sole discretion to consider whether the reason for waiving the no-show fee is valid, and will inform the Member about the decision in writing. Phone calls or social media messages are deemed invalid requests to waive the no-show fee and will thus be disregarded.
5. Privacy
5.1. Saints & Stars processes Member personal data within the parameters of the applicable laws and regulations regarding privacy protection, in particular the Personal Data Protection Act, in a manner and for the purposes described in the Saints & Stars Website Terms and Conditions.
5.2. Saints & Stars processes personal data for the following purposes: billing, accounts receivable records, complaints handling and dispute settlement, the information provided to the member’s employer regarding the use of the membership; for the prevention, detection and control of fraud and irregularities, for market research and commercial purposes such as sales activities related to the services provided by Saints & Stars and/or third-party services connected to the services provided by Saints & Stars.
5.3. The Member is entitled to view, correct, and object to the personal data processed. Saints & Stars will be authorized to charge a fee up to the statutory maximum for access to and/or the incorporation of corrections and/or the processing of an objection. The Member may object to Saints & Stars’ use of his/her personal data and send requests to access, correct and object to Saints & Stars.
6. Termination
6.1. Cancellation of a membership is possible with a 4 weeks’ notice at the end of the commitment period. A 4 weeks notice starts after the end of the last payment term. The membership must be active during the 4-week cancellation period. E.g. when a flex membership has been purchased on March 5, and cancelled on March 20, the end date will be April 29 (end of last payment term + 4 weeks).
6.2. The cancellation has to be made in writing by sending a request to the official informational email of Saints & Stars, namely info@saints-stars.com and confirmed by the Member after receiving the formal ending date of the membership as stated by Saints & Stars according to the Article 6.1 of these terms and conditions. Verbally requesting to terminate the membership at the reception or calling the front desk staff will be deemed as invalid termination requests.
6.3. The Member is eligible to request termination of the membership within the commitment period without an external fee if they move outside of a 50km radius of a Saints & Stars location. The Member can request to do so with proof of residence change. Both requests are at the discretion of Saints & Stars and require the regular 4 (four) week cancellation policy.
6.4. Saints & Stars provides a Buy-out option. If a Member requests to terminate the Gold 1-year membership sooner than 52 (fifty-two) weeks elapse, Saints & Stars will issue a one-time buy-out fee amounting to € 350,- (three hundred and fifty) euros, payable by the Member in one go. To request to terminate the Gold 1-year membership prior to finishing the 52 (fifty- two) weeks of the commitment period, the procedures provided in Articles 6.1 and 6.2 of these Terms and Conditions apply.
6.5. Saints & Stars is authorized to terminate the membership without a notice of default or notification:
a. if the Member has failed to complete all payments or failed to do so in a timely manner. Articles 4.2, 4.3 and 4.4 of these Additional Terms and Conditions still apply.
b. if the Member withdraws the authorization for Stripe Direct Debit and/or a direct debit is rejected. Articles 4.2, 4.3 and 4.4 of these Additional Terms and Conditions still apply.
c. if the Member is declared bankrupt, applies for a moratorium (temporary or otherwise), has made debt settlement arrangements or is placed under guardianship.
d. If the Member fails to comply with the internal rules provided in Section 15 of the Terms and Conditions and/or section 11 of the Additional Terms and Conditions, the Member may be refused or denied access to Saints & Stars and its facilities.
7. Suspension (Temporary Membership Cancellation)
7.1. In the event of long-term illness, incapacitation, pregnancy or injury, a temporary suspension of membership may be granted with a written permission of Saints & Stars. Suspension is only possible under a written submission, acceptance and confirmation to the Member in writing by Saints & Stars. For other reasons (a holiday for example) the Member is allowed to temporarily freeze the membership, up to a maximum of 4 (four) periods of one-week installments every 52 weeks from the start date of the membership. During a suspension it's not possible to book workouts.
7.2. In the case of national restrictions or special government measures prohibiting the operation of gyms and Saints & Stars thereof, a collective suspension on all active memberships may be imposed for an indefinite duration, or until the national restrictions or government measures change and regular services can be provided again. The scope, extent and duration of the special collective membership suspension is at the sole discretion of Saints & Stars, and upon such circumstance members receive a digital notice via email issued by Saints & Stars providing information about the event, (expected) duration and any other important information. In the case of a special collective membership suspension, provisions in article 7.5 prevail.
7.3. In the case of national restrictions or special government measures limiting, but not prohibiting, the operation of gyms and Saints & Stars thereof, thus allowing Saints & Stars to provide (limited) services, Saints & Stars reserves the right to continue keeping memberships active according to the regulations provided in these terms and conditions. Members may send a personal written temporary suspension request according to the procedures stated in article 7.1 of these terms and conditions. In such circumstance, article 7.5 prevails.
7.4. The membership can never be suspended retroactively.
7.5. The Member’s payment obligation will be deferred to the actual term of the suspension. The termination date of the membership contract will be extended by the term of the actual suspension. This also applies in extraordinary circumstances, such as national restrictions or emergency government measures.
8. Hours of operation
8.1. Saints & Stars is authorized to close all or a portion of its facilities during national public holidays, school holidays and/or special internal events.
8.2. Saints & Stars is authorized to change the hours of operation of a facility or sections thereof.
8.3. Saints & Stars is authorized to close the facilities for repair and maintenance work.
9. Complaints and Requirements to Provide Information
9.1. Any changes in the Member’s personal situation (legal name, bank details and so forth) must be immediately communicated in writing to Saints & Stars.
9.2. In the event of failure to communicate these changes or failure to do so in a timely manner, and if Saints & Stars is compelled to incur expenses in attempting to establish the new personal data, such expenses will be charged to the Member.
9.3. In the event of complaints relating to Saints & Stars and its services, the Member must first contact the front desk assistant for the fastest possible solution and, secondly, address the issue in writing to Saints & Stars, describing the issue detailed and accurate.
10. Liability
10.1. Saints & Stars will not be liable for any injury or accident occurred on its premises, or any lost items of any nature whatsoever and which have gone missing for any reason whatsoever, except in the case of willful misconduct or deliberate recklessness on the part of Saints & Stars and its staff.
10.2. Each Member is individually responsible for personal accidents and their personal possessions. Neither Saints & Stars nor its employees can be held liable for the loss, damage or theft of goods at the facility’s site.
11. Internal Rules
11.1. The Member is familiar with Saints & Stars’ internal rules regarding cleanliness, theft and proper social behavior. The Member is required to comply with these internal rules and can approach the front desk staff to clarify either of the regulations.
11.2. The gym is entitled to refuse or deny access at any time to individuals whose behavior is deemed inappropriate by the staff of Saints & Stars.
12. Final provisions
12.1. All membership regulations provided in these Terms and Conditions by Saints & Stars are governed by Dutch law.
12.2. If any one of the provisions stated above is invalid or unlawful, the other provisions will remain in effect.
